Implementation of the constitutional provision that Russia is a legal

the state is fully dependent, first of all, on the activities of state authorities and local self-government.

In the current conditions, society and authorities are interested in the full implementation of the legal foundations for managing public relations and in the consistent democratization of the management process. Law and law lead the regulation regimes and establish the procedure for the activities of government bodies, officials, legal entities and individuals.

The legal mechanism is one of the essential means of managing society, because the effectiveness of management activities, and ultimately the welfare of society, largely depends on the timely and correct resolution of legal issues. Therefore, the legal support of the activities of state authorities and local self-government significantly affects the effectiveness of the functioning of these bodies.

For the purposes of legal support for the activities of authorities and local self-government, by decision of the authority itself, a special service is created - a legal (legal) service. When creating a legal service, the authority, based on the functions assigned to it by the Constitution of the Russian Federation and federal legislation, determines the tasks and functions of the legal service, its structure and staffing.

This collection includes regulations on the legal (legal) service of the President of the Russian Federation, the chambers of the Federal Assembly of the Russian Federation, the legislative and executive authorities of the Nizhny Novgorod region, the City Duma and the Administration of Nizhny Novgorod. The collection contains the Regulations on the Staff of the Government of the Russian Federation and the main issues of the jurisdiction of the Legal Department of the Government in order to illustrate the versatility of the activities of the legal service, its relationship with other departments of the Government in the legal support of the activities of the highest executive body of the state.

In order to provide legal support for the activities of the federal executive body, to carry out work related to the improvement of legislation regulating issues within the competence of the federal executive body, as well as to improve the quality of draft regulatory legal acts, a legal service is created as part of each federal body (its apparatus).

The legal service of the federal executive body acts in accordance with the regulation developed on the basis of the model regulation approved by the Government of the Russian Federation. The collection contains the Decree of the President of the Russian Federation "On some measures to strengthen the legal services of state bodies", the Government's resolution on the approval, in pursuance of the said Decree, of the model regulation on the legal service of the federal executive body and the text of this model regulation.

Among the federal executive authorities, the Ministry of Justice occupies a special place in the legal support for the functioning of government bodies, and in this regard, the Provision on the Ministry of Justice of the Russian Federation is included in the collection.

Legal support for the activities of the judiciary is provided by the apparatus of the relevant court. The collection contains extracts from the relevant federal laws. Within the apparatus of the relevant court, subdivisions are created to ensure the activities of the court, including a subdivision for the legal support of the activities of the court. 5. Management for the implementation of its tasks and functions has the right:

6. 7. 8. 1. 12) ensures the certification of civil servants in the Administration of the Federation Council, assigns qualification categories to civil servants of the Administration of the Council of the Federation, with the exception of those assigned by the President of the Russian Federation;

13) encourage distinguished employees of the Administration of the Federation Council in accordance with the established procedure;

20) dispose of financial resources in accordance with the cost estimate for ensuring the activities of the Federation Council of the Federal Assembly of the Russian Federation;

21) signs official and other documentation, as well as certificates of employees of the Administration of the Federation Council and assistants to members of the Federation Council.

18. First deputies and deputies of the Chief of Staff of the Federation Council direct and control the activities of structural subdivisions of the Staff of the Federation Council in accordance with the distribution of duties between them.

19. The head and deputy head of the Secretariat of the Chairman of the Federation Council, assistants and advisers to the Chairman of the Federation Council are appointed by the Chairman of the Federation Council for the term of his powers and dismissed by the Chairman of the Federation Council after this period or ahead of schedule in accordance with the procedure established by the legislation of the Russian Federation.

The heads of the secretariats of the first deputy and deputy chairmen of the Federation Council, their deputies, assistants and advisers to the first deputy and deputy chairmen of the Federation Council are appointed to the position for the term of office of the respective first deputy, deputy chairmen of the Federation Council and are dismissed by the chairperson of the Federation Council upon the expiration of this term or upon the presentation of the First Deputy Speaker of the Federation Council, the Deputy Chairmen of the Federation Council, respectively, ahead of schedule in accordance with the procedure established by the legislation of the Russian Federation.

The Regulations on the Secretariat of the Chairman of the Federation Council are approved by the Chairman of the Federation Council. The Regulations on the Secretariat of the First Deputy Speaker of the Federation Council and the Secretariats of the Deputy Speakers of the Federation Council are approved by the respective Deputy Chairmen of the Federation Council in agreement with the Chief of Staff of the Federation Council.

20. The heads of staff of committees and standing commissions of the Federation Council are appointed and dismissed by the Speaker of the Federation Council on the agreed recommendation of the chairman of the relevant committee or standing committee of the Federation Council and the Chief of Staff of the Federation Council.

Regulations on the staffs of committees and standing commissions of the Federation Council are approved by the chairman of the relevant committee or standing commission of the Federation Council and the Chief of Staff of the Federation Council.

The head of staff of a committee or a standing committee of the Federation Council is subordinate to the chairman of the relevant committee or standing committee of the Federation Council on issues related to ensuring their activities and to the Head of Staff of the Federation Council on other issues related to the organization of this activity.

21. The heads of departments (departments) of the Administration of the Federation Council and their deputies, as well as the heads of departments in the administrations of the Administration of the Federation Council, are appointed and dismissed by the Chairman of the Federation Council on the proposal of the Chief of Staff of the Federation Council.

Regulations on departments (departments) of the Administration of the Federation Council are approved by the Head of the Administration of the Federation Council.

The heads of departments (departments) of the Administration of the Federation Council ensure the implementation of the tasks assigned to these structural units. On issues within the competence of the structural subdivisions of the Staff of the Federation Council, their heads may issue orders of an organizational nature.

22. The appointment and dismissal of employees of the Office of the Federation Council specified in paragraphs 19-21 of this Regulation shall be made by orders of the Chairman of the Federation Council.

23. Employees of the Administration of the Federation Council, with the exception of those specified in paragraphs 19-21 of this Regulation, are appointed to and dismissed by orders of the Head of the Administration of the Federation Council on the proposal of the heads of the relevant structural divisions of the Administration of the Federation Council, agreed with the Department of Personnel and Civil Service of the Administration of the Federation Council , employees of the apparatuses of committees and standing commissions of the Federation Council in agreement with the chairman of the relevant committee and standing commission of the Federation Council.

24. The job descriptions of the Chief of Staff of the Federation Council and the head of the Secretariat of the Chairman of the Federation Council are approved by the Chairman of the Federation Council.

The job descriptions of the head of the Secretariat of the First Deputy Chairman of the Federation Council are approved by the First Deputy Chairman of the Federation Council.

The job descriptions of the heads of the secretariats of the Deputy Speakers of the Federation Council are approved by the respective Deputy Chairmen of the Federation Council.

The job descriptions of the heads of staff of committees and standing committees of the Federation Council are approved by the chairmen of the relevant committees and standing committees of the Federation Council and the Chief of Staff of the Federation Council.

The job descriptions of first deputies and deputies of the Chief of Staff of the Federation Council, heads of structural subdivisions of the Staff of the Federation Council not specified in this paragraph shall be approved by the Chief of Staff of the Federation Council.

The job descriptions of other employees of the Federation Council Staff are approved by the heads of the relevant structural subdivisions of the Federation Council Staff in agreement with the Personnel and Civil Service Department of the Federation Council Staff.

V. Peculiarities of the legal status of employees of the Staff of the Federation Council

25. State positions of the federal civil service in the Office of the Federation Council shall be filled by citizens of the Russian Federation.

26. Employees who hold public positions in the federal public service in the Office of the Federation Council are federal public servants.

27. Federal civil servants of the Administration of the Council of the Federation are guided in their activities by the principle of non-partisan civil service.

28. The rights, duties, responsibilities and working conditions of employees of the Administration of the Federation Council are determined by the legislation of the Russian Federation on public service and labor, the collective agreement, these Regulations, the Internal Labor Regulations of the Administration of the Federation Council, regulations on structural subdivisions of the Administration of the Federation Council, job descriptions and other normative acts.

Employees of the Administration of the Federation Council are issued certificates in accordance with the Regulations on certificates issued in the Federation Council of the Federal Assembly of the Russian Federation, approved by the Chief of Staff of the Federation Council.

29. Federal civil servants and other employees of the Office of the Federation Council, in terms of remuneration, social, medical, transport and logistical support, are equated with the corresponding categories of federal civil servants and other employees of the Administration of the President of the Russian Federation and the Office of the Government of the Russian Federation.

30. In connection with the termination of employment relations, federal civil servants of the Administration of the Federation Council shall return to the head of the relevant structural unit of the Administration of the Federation Council all documents containing official information, and an official certificate to the Personnel and Civil Service Department of the Administration of the Federation Council.
