Regulation of this type of trade is carried out on the basis of the Rules for the sale of goods by remote means, established by Decree of the Government of the Russian Federation of September 27, 2007 No. 612. The norms of the above legislative acts apply without restrictions to the purchase and sale of goods through online stores.

The sale of goods through the online store takes place on the basis of a retail sale and purchase agreement concluded between the seller of the goods and the buyer. In accordance with paragraph 2 of Art. 432 of the Civil Code of the Russian Federation, such agreements are concluded by sending an offer (proposal to conclude an agreement) by one of the parties and its acceptance (acceptance of the offer) by the other party. Proposals containing all the essential terms of the contract, which can be accepted by anyone who responds, are recognized as a public offer in accordance with Art. 437 of the Civil Code of the Russian Federation.

The seller's obligations to transfer the goods to the buyer arise from the moment he receives the corresponding message from the buyer about his intention to conclude a contract for the purchase of goods (acceptance).

The acceptance of the buyer is an application in which the potential buyer of the goods must indicate the following:

  • the name and address of the seller,
  • your last name, first name and patronymic (or another person who is the recipient of the goods),
  • the address to which the goods are to be delivered,
  • name of the product, article number, brand, variety, number of items included in the package of the purchased product, price of the product,
  • type of service (when provided), time of its execution and cost,
  • buyer's obligations.

The online store (seller of the goods) is obliged to deliver the goods to the place indicated by the buyer within the time period established by the contract, and if such is not named, to the place of residence of the citizen (clause 1, article 499 of the Civil Code of the Russian Federation). In order for the retail sale contract to be considered fulfilled, it is not necessary to transfer the goods directly to its buyer. In the absence of a buyer, the goods may be transferred to any person who has presented a receipt or other document evidencing the conclusion of an agreement or the delivery of goods (clause 2, article 499 of the Civil Code of the Russian Federation).

Ownership rights to the goods under contracts that include the condition of their delivery by the seller are transferred from the seller to the buyer at the time of delivery of the goods to the buyer.

The possibilities for the consumer to refuse the goods are specified in paragraph 4 of Art. 26.1 of the Law "On Protection of Consumer Rights". The buyer has the right to refuse the goods at any time before its transfer, and after the transfer of the goods - within 14 days.

Return of goods of proper quality is possible if its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the specified goods are preserved.
