How to “find” a relevant topic for a dissertation?
The beginning of postgraduate study is a period of active scientific research, which, as a rule, is accompanied by the emergence of a lot of questions in the postgraduate student.
It is very difficult to answer these questions.
On the educational literature market, there are few current teaching aids devoted to the implementation of qualifying scientific works; their overly theorized and therefore divorced from reality recommendations are difficult to perceive (read - incomprehensible) by young scientists.
A modern graduate student is most often not ready for independent scientific work, and the appointed supervisor, given his busy schedule, does not have time to engage in “educational” work.
Scientific supervision, even in universities with a serious scientific school, comes down to rare meetings with graduate students and reading completed works. The effectiveness of interaction often depends on the goodwill of the supervisor and his “sympathy” for the graduate student.
As a result, there is a decrease in the already low scientific activity of graduate students and applicants. The occurrence of such difficulties does not allow them to fully realize the possibility of independent research activities. In the absence of proper motivation and a busy work schedule, a graduate student receives a strong impulse to pay money and shift the responsibility for writing a dissertation to a third party.
This “forced” demarche is quite understandable. However, no matter how difficult it is to start a scientific activity, I still do not recommend trusting the abstract company to develop the problems of your dissertation research.
Is it possible to independently choose a topic for a dissertation without having experience in scientific work?
I responsibly declare that nothing is impossible... for a person... with intelligence.
If you approach the choice of dissertation topic strategically, then Of course, you should start with choosing a scientific specialty. Some people make this choice even before entering university or during their studies. Postgraduate study becomes a logical continuation of the research work carried out by the student during the period of study within the chosen specialty, and graduation qualifying work- the basis of the essay provided upon admission to graduate school.
However, as practice shows, future graduate students often do not quite understand what research topic to choose. In this case, the ideal option would be to combine the topic of scientific research with the area of the main work.
Be that as it may, the search for a relevant dissertation topic should begin with a conversation with your supervisor. Sometimes this path is the simplest and shortest. The supervisor (if desired) can, at the first meeting, tell you about the problems existing in your field of knowledge, which, through joint efforts, you will be able to “develop” into a dissertation topic.
Unfortunately, not all scientific supervisors are so generous in their participation, reserving problem topics for a “special occasion”. If this is the case, don't despair.
There are several directions for searching for a relevant dissertation topic:
1. If you work in your main specialty, you may be aware of problems (for example, social problems, problems of law enforcement practice, etc.), which can become the basis for developing a dissertation topic. For lawyers, the source of such information can, for example, be materials from judicial practice, including reviews prepared by courts at various levels. State the identified problems, summarize and discuss with your supervisor. Perhaps problems in practice arise due to the insufficient development of existing theoretical approaches. For example, problems in law enforcement practice are caused by insufficient development of legal theory. It is precisely this descriptive method that I have used more than once to develop the topic of my dissertation on civil law at the beginning of his work in the field of scientific consulting.
2. Analyze your graduate school programs by area. Among the problems declared for study there may be actual ones. In my practice, there have been several cases when course syllabuses included a separate list of topics recommended for graduate students as dissertations.
3. View recently defended papers in your specialty, primarily defended in your department over the past year. Perhaps the problems posed in them are still relevant, but there is still not enough research devoted to them. In this case, you can raise the question of developing these topics in your dissertation.
Example: The topic of the recently defended work in specialty 12.00.01 “The role of law in the development of science and education.” You may well formulate your topic as follows: “The role of law in the development of science and innovation,” etc. You can be sure that it is relevant.
Remember that choosing a research topic must be within the scope of your scientific specialty passport. If your specialty as a researcher is 12.00.01 - “Theory and history of law and state; history of legal doctrines", then its contents are "<…>ideas, ideas, designs, concepts and categories, hypotheses and forecasts, reflecting the current level of knowledge about the general patterns of the emergence, development and functioning of law and the state<…>».
Explore the research areas of your specialty passport. The topic must be formulated (read - consonant) within the framework of one point or another. In any case, the topic you choose is subject to validation by the department. First of all, your supervisor must recognize the dissertation topic. It may happen that the topic is interesting from a practical point of view, but there is no “science” in it.
Beware of choosing a less-researched topic(on which practically nothing has been written).
This may seem tempting, but absolute innovation is difficult; you have to prove every point. Are you ready for this? If you are “swimming” in the topic, you will not be able to cope without serious scientific guidance. On the other hand, if you choose a topic that has already been the subject of research many times, you will most likely encounter difficulties in proving novelty, which practically means that your work on writing a dissertation will be in vain.
Justification of the relevance of the topic is one of the initial stages of research. “Relevance” as applied to a dissertation means the timeliness and social significance of the research. The justification for the relevance of the topic should be succinct and therefore short.
The main thing is to describe the essence of the problem, i.e. a contradictory situation that requires resolution. This situation often arises as a result of the action of new factors (conditions) that can change (develop) previous theoretical ideas. These may be new economic conditions, for example, “the transition to a new qualitative state of the world economy,” etc. As a result, it is possible, for example, to reconsider existing approaches to “mechanisms of legal regulation of economic development.”
To formulate a scientific problem means to find out known and unknown facts about the subject of research, to analyze the degree of development of the problem. The research topic determines the research methodology, its purpose and objectives. With the correct choice of research topic, already at this initial stage, one can assume its theoretical and practical significance, as well as its scientific novelty. Avoid broad topics. Dissertations “about everything” are often in fact “about nothing”; they are often superficial and not independent.
Sometimes, within the framework of a dissertation research, it is advisable as a goal to determine the development of theoretical positions previously put forward by one or another scientific school. For example, you can develop your own approach to solving a scientific problem, i.e. solve specific issues within the framework of one or another previously tested concept.
Let's summarize the above:
The topic should be interesting to you;
Avoid setting the topic too broadly;
The topic should be timely and socially relevant, as well as interesting in comparison with other similar studies;
Choose a goal and tasks that you can solve within the time frame established for the study;
Make sure you can find all the necessary sources and literature.

And the last piece of advice - always approve the topic of the dissertation at the department(with the participation of the scientific supervisor). No matter how it sounds, there are situations when a graduate student spends 3 years working hard on a dissertation, the topic of which no one has agreed upon. And the incident I am describing happened not just somewhere, but in a respected Moscow university.
